Terms of Service and End User License Agreement Applicable Date: February 25, 2025.

This is an agreement (the "Agreement") between you and Interaccess LLC, 1150 NW 72nd Ave Ste 455, Miami, FL 33126, InteracessGame (hereinafter referred to as "InteracessGame") and your use of InteracessGame's games, websites, forums and related services (the "Services").

This Agreement, as amended from time to time and posted herein, is supplemented by the InteracessGame Privacy Policy (https://interaccessgame.com/tremble.html), which is incorporated herein by reference.

Please Note:

As a condition to your use of the Services, you must agree to this Agreement.

By agreeing to this Agreement, you represent that you are at least 13 years of age. If you do not have the legal capacity to enter into this Agreement, you represent that your legal guardian or any person legally responsible for your interests has agreed to the terms of this Agreement.

By accessing the Services, you agree to be bound by the terms of this Agreement and the terms set forth below. If you do not agree to this Agreement, you may not use the Services.

If the Services are available for free use or download, such Services may include features that allow you to make purchases within the Services.

1. Acknowledgement and Acceptance of Terms and Conditions

These Services are provided subject to your compliance with all of the terms and conditions contained herein and all other operating rules, policies and procedures. In addition, certain Services may require additional terms and conditions promulgated by InteracessGame from time to time. Any material modifications to this Agreement will also be brought to your attention by posting on InteracessGame's website. Such material modifications will be effective immediately and will apply to disputes arising from this Agreement from the date of posting. Your continued use of the Services after modifications to this Agreement constitutes your acceptance of such modifications.

2. Limited Use License

Subject to this Agreement, InteracessGame hereby grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use the Services for personal and non-commercial use. This Agreement also applies to any patches or updates obtained for the Services. The rights granted to you are conditioned on your full compliance with this Agreement.

3. Third-Party Services

The Services may include links to third-party services (including, but not limited to, advertisements provided by third parties) and/or third-party services may be made available to you through the Services. These services may include, but are not limited to: game recording and sharing, social media connections and advertising. These services are subject to the respective third-party terms and conditions. Please read these third-party terms and conditions carefully, as they constitute an agreement between you and the applicable third-party service provider, and InteracessGame is not a party thereto.

4. License Conditions

You agree to use the Services only in a manner consistent with this Agreement. Therefore, under no circumstances may you:

Use the Services or any part thereof for commercial purposes;

Sell, rent, lease, license, distribute or otherwise transfer the Services or any part thereof or any copies thereof;

Reverse engineer, derive source code, modify, decompile, disassemble, copy or create derivative works from all or part of the Services, except as expressly permitted by applicable law

Directly or indirectly use any cheats, exploits, automation software, robots, hacks, modules or any unauthorized third-party software to modify or interfere with the Services.

Use the Services in violation of any applicable laws or regulations.

Disrupt, interfere with or otherwise adversely affect the normal flow of the Service, or otherwise negatively impact other users’ experience when using the Service.

Damage, overburden, assist or facilitate the disruption or overburdening of any computer or server used to provide or support the Service.

Attempt to gain unauthorized access to the Service, accounts registered to others, or computers, servers or networks connected to the Service by any means other than the user interface provided by InteracessGame, including, without limitation, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting anyone else to circumvent or modify; any security, technology, device, encryption or software that is part of the Service.

Post any information, content or other material (or post links to any information or content) that contains nudity, excessive violence or is abusive, threatening, obscene, defamatory, libellous, or racially, sexually, religiously or otherwise objectionable or offensive.

Attempt to harass, abuse or harm another person, or advocate or incite harassment, abuse or harm of another person, group, including InteracessGame employees, directors or officers, including InteracessGame’s customer service representatives.

Make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity or other right of any person or entity, or impersonate any other person, including, without limitation, an InteracessGame employee, director or officer.

Engage in any conduct that InteracessGame deems to be in conflict with the spirit or intent of the Service, or improperly use InteracessGame's support services.

5. Injunctions

Because InteracessGame will suffer irreparable harm if the terms of this Agreement are not expressly performed, you agree that InteracessGame will be entitled to take such action as may be necessary, including seeking injunctions and other equitable remedies, in addition to any other remedies that may be available under applicable law.

Suspension and Termination for Your Violations

Without limiting any other legal or equitable remedies, InteracessGame reserves the right to suspend and/or terminate your access to the Service, with or without notice to you, if you violate the terms and conditions set forth in this Agreement.

6. Availability of the Service

If InteracessGame has reason to believe that you (i) have created any risk or exposed InteracessGame to any possible liability, or (ii) have infringed the intellectual property rights of a third party, InteracessGame may restrict, suspend or terminate the Service or part of it, and take technical and legal measures to prevent users from accessing the Service.

7. Disclaimer

To the maximum extent permitted by applicable law, you expressly agree that the Service is provided to you on an "as is" basis. Therefore, such Service is provided at your sole risk and with the assurance of satisfactory quality, performance, precision and effort. Therefore, InteracessGame does not make, and hereby disclaims any and all warranties, express, implied or statutory, including, but not limited to, the implied warranties of condition, uninterrupted use, accuracy of data (including, but not limited to, location data), merchantability, satisfactory quality, fitness for a particular purpose, non-infringement of third party rights, and warranties (if any) arising from a course of dealing, usage or trade practice. InteracessGame does not: (A) warrant that interference with your enjoyment of the Service will be prevented; (B) that the Service will meet your requirements; (C) that the operation of the Service will be uninterrupted or error-free; or (D) that the Service will interoperate or be compatible with any other service or that any errors in the Service will be corrected. No oral or written advice given by InteracessGame or its employees or other representatives shall constitute a warranty.

If any jurisdiction does not allow the exclusion of any warranty in the manner set forth above, such provisions may not apply to you. In such case, the above warranty exclusions shall apply to the maximum extent permitted by applicable law in such jurisdiction.

8. Limitation of Liability

In no event shall InteracessGame or its affiliates be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages whatsoever, including, without limitation, damages resulting from loss of use, data or profits, whether or not we have been advised of the possibility of such damages, and on any theory of liability arising out of or in connection with the use of the Service, including damages for property damage, loss of goodwill, computer failure or malfunction, and, to the extent permitted by law, personal injury, even if InteracessGame has been advised of the possibility of such damages.

Because some states or jurisdictions do not allow the exclusion or limitation of consequential or incidental damages, in such states or jurisdictions, InteracessGame's liability shall be limited to the maximum extent permitted by law. In no event shall InteracessGame's total liability arising out of or related to this Agreement or the Service exceed the greater of: (I) the actual price paid by you for the license to use the Service, if any; or (II) one hundred dollars (US$100). The exclusion and limitation of damages are fundamental elements of the basis of the bargain between InteracessGame and you.

Some jurisdictions do not allow certain limitations of liability set forth above, so the above may not apply to you. Instead, in such jurisdictions, the limitations of liability set forth above shall apply only to the extent permitted by the laws of such jurisdictions.

9. Indemnification

You agree to indemnify, defend and hold harmless InteracessGame (including, without limitation, InteracessGame’s officers, directors, agents and employees) from and against any claim, demand, damages or other losses, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Service or your breach of this Agreement.

10. Third Party Products and Services

You understand that the Service may link to third party websites or services. InteracessGame makes no promises about such products or services offered by such third parties, and you agree that InteracessGame does not endorse such products or services. If you provide data to such third parties, you fully understand that your provision of data is subject to such third party’s privacy policy, if any, and in such event, InteracessGame’s Privacy Statement does not apply to such data.

11. Amendments or Updates

InteracessGame may amend or update this Agreement from time to time. Whenever InteracessGame makes any updates or revisions to this Agreement, InteracessGame will take appropriate steps to notify you through the Service or other means.

If you continue to access or use the Service after the update or revision becomes effective, you agree to be bound by the updated or revised Agreement.

12. Severability

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law (including, but not limited to, the above disclaimers and limitations of liability), then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement will continue in effect to the fullest extent permitted by law.

13. No Waiver

Our failure to enforce or exercise any provision of this Agreement or related rights shall not constitute a waiver of such right or provision.

Assignment

InteracessGame may assign this Agreement, in whole or in part, at any time. Notwithstanding the foregoing, you may not assign, transfer or sublicense any or all of your rights or obligations under this Agreement or the Privacy Policy without InteracessGame’s prior express written consent.

14. Entire Agreement

This Agreement represents the entire agreement between you and InteracessGame regarding the Services and supersedes all prior agreements and representations, warranties or understandings between you and InteracessGame with respect to the same subject matter (whether entered into negligently or innocently, but excluding agreements and representations, warranties or understandings entered into fraudulently).
